1. Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of the website at space.tickets and its related pages, content, store, and features (together, the "Site"). The Site is operated by The Space Tickets Company LLC, a Florida limited liability company and a subsidiary of Kleology Holdings LLC ("space.tickets®," "we," "us," or "our").

By accessing or using the Site, by tapping a control that says you accept these Terms, or by placing an order through our store, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

2. What space.tickets® is, and what it is not

space.tickets® is an independent editorial and informational resource about civilian spaceflight, and it operates an online store for branded merchandise. We publish information, summaries, and commentary, we point visitors toward the official websites of spaceflight operators, and we sell our own merchandise.

space.tickets® does not sell seats, tickets, flights, or any spaceflight or travel product. We do not hold or reserve flight inventory. We do not represent any spaceflight operator. We are not a travel agent, a tour operator, a seller of travel, or a booking agent of any kind. We do not arrange, broker, or transact the purchase of any flight or experience. Any reservation, purchase, pricing, eligibility decision, or contract for spaceflight is made solely between you and the operator you choose, and we are not a party to it.

Our store sells merchandise only. A purchase in our store is a purchase of physical goods and has no connection to any spaceflight, seat, reservation, or operator.

3. Eligibility

You must be at least 18 years old to use the informational features of the Site or to submit any information through the file feature. To purchase merchandise, you must be at least 18 years old or have the permission and involvement of a parent or legal guardian. By using the Site, you represent that you meet these requirements. Spaceflight operators set their own age, medical, and eligibility requirements, which differ from ours and which we do not control.

4. The "file" feature

The Site may invite you to share certain details so that we can keep an editorial file of your interests. Sharing those details is voluntary. A file is not a reservation, a waitlist, a queue position, a ticket, an option, or a commitment of any kind, by you or by us. It creates no right to fly, to purchase, or to priority with any operator. We may contact you about the matters you described, as described in our Privacy Policy, only where you have given consent to be contacted.

5. Information only; no advice; information changes

Content on the Site is provided for general information. It is not professional, financial, investment, legal, medical, or travel advice, and you should not rely on it as such. Prices, dates, availability, programs, and operator details in the civilian spaceflight market change frequently. Any figure we publish is a point-in-time reference drawn from public sources, and the operator's own current information always governs. Verify everything that matters to you directly with the operator before making any decision.

6. Third-party operators, links, and referral relationships

The Site links to and describes third parties, including spaceflight operators. We do not own, operate, endorse, or control those third parties or their content, and we are not responsible for them. Your dealings with any third party are solely between you and that third party. We may in the future earn a referral or affiliate fee when you follow certain links to tools, services, or operators. Where that is the case, it does not change the price you pay, and it does not influence our editorial selection or commentary. See our Editorial Independence Disclaimer.

7. Merchandise sales

This section governs purchases of physical merchandise ("Products") from our store.

Store, checkout, and payment. Our store is presented on the Site, and checkout and payment are handled by Shopify. Payments are processed through Shopify Payments. We do not receive or store your full payment card number. By placing an order, you authorize the charge for the Products, applicable taxes, and shipping.

Products are made to order. Our Products are produced on demand through our fulfillment partner, Printify. Because each item is made individually, slight variations in color, print placement, and finish are normal and are not defects. Product images are illustrative, and actual colors may vary with your screen.

Pricing, currency, and tax. Prices are shown at checkout and are payable in the currency stated there. Prices may change at any time before you order. Applicable sales tax is calculated and collected at checkout through Shopify Tax based on your delivery destination.

Order acceptance. Your order is an offer to buy. We may accept or decline it, and we may cancel an order before or after it is placed if a Product is unavailable, if there is an error in pricing or description, or if we suspect fraud or a violation of these Terms. If we cancel an order you have paid for, we will refund that order.

Shipping. We ship within the United States and internationally. Because Products are made to order, an order moves through a production stage and then a shipping stage, so total delivery time is the production time plus the transit time for your destination. Delivery estimates are estimates, not guarantees, and we are not responsible for delays caused by carriers, customs, weather, or events beyond our control.

International duties and import taxes. International orders may be subject to customs duties, import taxes, or fees charged by the destination country. These are set by that country, are the recipient's responsibility, and are separate from the amount you pay us at checkout.

Damaged, defective, or incorrect items. If a Product arrives damaged, defective, or not as ordered, contact us at go@space.tickets within 30 days of delivery with your order number and a photo, and we will replace it or refund it at no cost to you, including any return shipping.

Returns and refunds. Returns and refunds are governed by our Shipping and Returns / Refund Policy, which forms part of these Terms.

Risk and title. Title to a Product passes to you when it is delivered. If a Product is lost or damaged in transit, contact us and we will work with you to resolve it as described above.

8. Intellectual property

The Site and its contents, including text, design, graphics, merchandise designs, and the compilation of all content, are owned by or licensed to us and are protected by intellectual property laws. space.tickets® is a registered trademark of Kleology Holdings LLC (U.S. Reg. No. 8,311,591) and is used by The Space Tickets Company LLC under license. You may not copy, reproduce, republish, scrape, frame, sell, or create derivative works from the Site, the Products' designs, or the mark without our prior written permission. All rights not expressly granted are reserved.

No part of this site may be used to develop, train, or improve any machine learning or artificial intelligence system without our prior written permission, except by search and AI services that we expressly permit through our published site files.

9. Acceptable use

You agree not to: use the Site for any unlawful purpose; submit false, misleading, or another person's information; make a purchase with a payment method you are not authorized to use; attempt to gain unauthorized access to the Site or its systems; interfere with or disrupt the Site; scrape, harvest, or collect data from the Site by automated means; or use the Site or our content to develop a competing product through systematic extraction.

10. Disclaimer of warranties

The Site is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information on it is complete, accurate, or current. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you, and you may have warranty rights for Products under the law of your jurisdiction that these Terms do not limit.

11. Limitation of liability

To the fullest extent permitted by law, The Space Tickets Company LLC, Kleology Holdings LLC, and their officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of, or inability to use, the Site, even if advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for any claim relating to the informational Site will not exceed one hundred US dollars, and our total aggregate liability for any claim relating to a Product will not exceed the amount you paid for that Product. Some jurisdictions do not allow certain limitations, so some of this may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless The Space Tickets Company LLC, Kleology Holdings LLC, and their officers, members, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of your use of the Site, your purchases, your violation of these Terms, or your violation of any law or third-party right.

13. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and by applicable US federal law. Subject to the dispute resolution section below, the state and federal courts located in Miami-Dade County, Florida have exclusive jurisdiction, and you consent to that venue.

14. Dispute resolution; arbitration; class waiver

Please read this section carefully. It affects how disputes are resolved.

Informal resolution first. Before starting any formal proceeding, you agree to contact us at go@space.tickets and give us 30 days to resolve the matter informally.

Binding arbitration. If we cannot resolve a dispute informally, you and we agree that any dispute arising out of or relating to these Terms, the Site, or a purchase will be resolved by final and binding arbitration administered by a recognized arbitration provider under its consumer rules, rather than in court, except as stated below. The arbitration will take place in Miami-Dade County, Florida, or by remote means, and the arbitrator's decision may be entered as a judgment in any court of competent jurisdiction.

Small-claims carve-out. Either party may bring an individual claim in small-claims court instead of arbitration if it qualifies.

Class-action waiver. You and we agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.

30-day opt-out. You may opt out of this arbitration and class-waiver section by emailing go@space.tickets within 30 days of first accepting these Terms, stating your name and a clear request to opt out. Opting out does not affect any other part of these Terms.

Exception. Either party may seek injunctive relief in court to protect intellectual property rights.

15. Changes to the Site and to these Terms

We may modify, suspend, or discontinue any part of the Site at any time. We may update these Terms from time to time, and the "Last updated" date shows when. Material changes take effect when posted, and your continued use of the Site or a new purchase means you accept the updated Terms.

16. Miscellaneous

If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms, together with the policies they reference, are the entire agreement between you and us regarding the Site. You may not assign these Terms; we may assign them to an affiliate or successor.
